Appointment Procedures
The Police Complaint Commissioner must maintain a list of retired judges who may be appointed as decision makers under the Police Act. The Police Complaint Commissioner must also establish and apply consistent and objective procedures when an appointment of a retired judge is necessary. These procedures, and the list of eligible retired judges, must also be posted to a publicly accessible website.
The list of retired judges is based on recommendations from the Associate Chief Justice of the Supreme Court. These retired judges may be appointed for:
- Public Hearings,
- Reviews on the Record,
- s. 117 Reviews, and/or
- Part 11 investigations where the allegation involves a Chief or Deputy Chief Constable.
