Public Hearings
At any time after receiving the Final Investigation Report, the Police Complaint Commissioner has the discretion to order a Public Hearing if the Commissioner determines it is necessary in the public interest.
A retired judge is appointed to sit as the adjudicator and review the evidence, hear sworn testimony and arrive at a decision of whether there is misconduct and, if substantiated, determine the corrective and/or disciplinary measures to be imposed. These public hearings are open to everyone.
Officers facing dismissal or a reduction in rank have the automatic right to a Public Hearing or, if the Police Complaint Commissioner approves, a Review on the Record.
