The continuation of a hearing into misconduct charges against Vancouver Police Department constables has been delayed due to health concerns amid the COVID-19 pandemic. The Public Hearing into the misconduct allegations facing Constables Eric Ludeman and Neil Logan began in early March and was set to conclude next week. The continuation of the hearing is contingent upon ensuring the necessary protocols are in place in accordance with guidelines set by the Office of the Provincial Health Officer and WorkSafe BC. The public will be advised of the rescheduled dates for the continuation of the hearing on the OPCC website. The hearing centres on misconduct allegations against Constables Ludeman and Logan, stemming from a complaint of excessive use of force and improper entry into a private residence. The complaint was investigated by the Victoria Police Department before being referred to a retired judge for review. The judge found that although the entry was unlawful, the officers had not committed misconduct. The Commissioner granted the complainant’s request for a Public Hearing into the allegations, noting that it was in the public’s interest to do so. View Release (.pdf)

The Office of the Police Complaint Commissioner (OPCC) has arranged a Review on the Record into the Victoria Police Department’s (VicPD) decision to dismiss a constable for discreditable conduct. The Discipline Authority found that Constable Brad Meyer had breached the Police Act through discreditable conduct in an incident on February 13, 2019. Among other allegations, he was found to have created a traffic hazard by shoveling snow onto a roadway and behaving in a profane and threatening manner when confronted by RCMP officers responding to the scene. After interviewing witnesses and collecting evidence under the oversight of the OPCC, the VicPD issued its determination on March 18, 2020, bearing out the allegations of discreditable conduct against Constable Meyer and proposing he be dismissed. In his Notice of Review issued today, the Police Complaint Commissioner noted that Constable Meyer requested a review of the decision to dismiss him from the Victoria Police Department and that the sole issue to be determined is whether the penalty of dismissal was reasonable. The Honourable Carole Lazar, retired Provincial Court Judge, will preside as the adjudicator of the review on the record, which has yet to be scheduled. View Release (.pdf)

The Police Complaint Commissioner has completed a review of the disciplinary decision dismissing a senior Vancouver Police Department Sergeant for misconduct occurring during an inappropriate relationship with a junior Vancouver Police Officer. The Office of the Police Complaint Commissioner wishes to advise the media that dates have been set for the Public Hearing into allegations of misconduct against Constable Eric Ludeman and Constable Neil Logan of the Vancouver Police Department. The Police Complaint Commissioner has called a Public Hearing into allegations of police misconduct involving a member of the Victoria Police Department following an investigation into a complaint of sexual misconduct while off duty. After an independent investigation by the Vancouver Police Department the matter was ultimately referred by the Commissioner to a retired judge for review. In a subsequent discipline proceeding, retired Judge James Threlfall determined that the evidence did not support a finding of misconduct. Subsequently, the Complainant requested the Police Complaint Commissioner arrange a Public Hearing. The Complainant and other material witnesses were not afforded the opportunity to testify at the discipline proceeding. The Commissioner considered this request and other factors and determined that it is in the public interest to arrange a Public Hearing. Upon the recommendation of the Associate Chief Justice of the British Columbia Supreme Court, the Honourable Judge Wally Oppal, Q.C., retired Supreme Court Justice, is appointed to preside as Adjudicator in these proceedings, pursuant to section 142(2) of the Police Act. As this matter involves allegations of a sensitive nature, names of the parties have been withheld from the Notice of Public Hearing to protect the identity of the Complainant. The Adjudicator may make further determinations concerning disclosure in the course of the Public Hearing. A date for the Public Hearing will be determined in the future. View Release (.pdf)

The Office of the Police Complaint Commissioner wishes to advise the media that a Review on the Record will be held into the disciplinary decision involving Special Municipal Constable Rajdeep Mann of the Vancouver Police Department and will commence in the near future. The Police Complaint Commmissioner has determined that the Discipline Authority’s findings after a discipline proceeding into allegations of Abuse of Authority, Discourtesy, Discreditable Conduct and Deceit were incorrect and is, therefore, remitting the matter for adjudicative review. Victoria - The Office of the Police Complaint Commissioner (OPCC) has ordered an investigation into the detention and arrest of an Indigenous man and his 12-year-old granddaughter at a Vancouver branch of the Bank of Montreal (“BMO”) which occurred on December 20, 2019. The OPCC became aware of the matter through media reporting and complaints from the public. Information was requested from the Vancouver Police Department and as a result, the Police Complaint Commissioner has concluded an investigation into the matter is required. The Police Act provides an authority for the Police Complaint Commissioner to order an investigation into the conduct of a police officer if the officer’s conduct would, if substantiated, constitute misconduct. The investigation will include any other potential misconduct or attempted misconduct which may have occurred. The investigation will also consider any Vancouver Police Department and Vancouver Police Board policies, procedures or training that may be a factor in this incident. Given the nature of this matter and the public comments of the Vancouver Police Department, the Commissioner has also determined that it is in the public interest the investigation be conducted by an agency other than the Vancouver Police Department. The Delta Police Department has been ordered to conduct an independent investigation into this matter. As this matter is under investigation no further information will be released at this time.
